Devis has been participating as an "intervenor" in a protest filed by the incumbent FedBizOpps.gov managing contractor. The Court of Federal Claims found in favor of the protestors in September 2006, but the government filed a Motion for Reconsideration. On February 23, 2007 the Court of Federal Claims rejected the Motion and confirmed the Court's decision to require GSA to appoint a new Source Selection Authority and to choose from among the remaining bidders, or start over from scratch. GSA must make their decision on whether to appeal, move forward, or cancel the procurement within 60 days.
Devis President Peter Gallagher commented: "Devis is pleased that the Court has clarified its finding and that the legal roadblock is now behind us. The Court has documented that Devis had the only technical approach ranked 'excellent with significant confidence.' Also, and more significant than the pricing anomalies with the now rejected award, was that two responses that were found to be not even technically 'acceptable' had their ranking changed to 'acceptable.' Unfortunately the excellent and thorough technical work done by GSA was overridden by non-technical staff. However, the Court provides a reasonable solution to quickly resolve the problems and the performance based nature of the RFP ensures that the responses have not become outdated."
